Terms of Service

These terms cover your use of bookingfence.com, the website of BookingFence, an owner-operated rental business in Arizona. Using the site or submitting an application means you accept them.

What this site does

The site lets you browse our rental properties, submit an application for a long-term lease, and find our furnished condos on VRBO and Airbnb for mid-term stays of one to six months. Bookings made on VRBO or Airbnb are governed by those platforms' own terms — this site currently links to them rather than processing bookings itself, and we are not responsible for those platforms' availability, content, or conduct. Stays are limited to guests 25 and older.

Applications

You must be at least 18 years old to submit an application.

  • Everything in your application must be truthful and complete. Inaccurate or falsified information is grounds for denying an application or, if discovered later, terminating a resulting lease.
  • Submitting an application is not a promise of housing. Properties can become unavailable, and applications are approved or denied after screening and review.
  • By applying, every adult applicant consents to a background, credit, and eviction-history check performed through KeyCheck.com, a consumer reporting agency. If an application is denied based on a screening report, you'll receive the adverse-action notice required by the Fair Credit Reporting Act, including the agency's contact information and your right to dispute the report.
  • Application resume links are personal to you. Keep them private — anyone with the link can view and edit your application.

Fair housing

BookingFence supports and follows the Fair Housing Act and the Equal Credit Opportunity Act. Every application is welcome and judged by the same written criteria.

Acceptable use

Using this site, you agree not to:

  • Hack, probe, or breach the site's security, bypass any access controls or rate limits, or test its vulnerabilities without our written permission
  • Scrape, harvest, or bulk-download content, or access the site with bots or other automated means (search engines indexing public pages excepted)
  • Misrepresent your identity, apply on behalf of someone who hasn't authorized you, or use another applicant's resume link
  • Upload malicious code, interfere with the site's operation, or disrupt other visitors' use of it

We may block traffic, discard applications, or refuse service where these rules are broken.

Communications

By applying, you consent to receive application-related notices from us electronically at the email address you provide — including any adverse-action notice the Fair Credit Reporting Act requires. Text messages are sent only if you opt in, and you can stop them by replying STOP.

Photographs and text on this site belong to BookingFence and may not be reused without permission.

Disclaimers & limitation of liability

The site is provided as-is. We work to keep listings, pricing, and availability accurate, but details can change and errors can occur; nothing on the site is a binding offer to lease. To the extent permitted by law, BookingFence's aggregate liability arising from your use of the site is limited to one hundred US dollars ($100). Nothing in these terms limits rights that Arizona landlord-tenant law, the Fair Housing Act, or the Fair Credit Reporting Act give you and that cannot be limited by agreement.

Governing law & changes

These terms are governed by Arizona law. If they change, the effective date above changes with them. These terms are the entire agreement about your use of the site; if any part of them is found unenforceable, the rest remains in effect, and our not enforcing a provision doesn't waive it.
